NOTICE OF APPLICATION TO SELL
REAL ESTATE AT PRIVATE SALE
NOTICE is given that the Testamentary Executrix of this succession has petitioned the Court for authority to sell property belonging to the decedent at private sale in accordance with the provisions of Article 3281 of the Code of Civil Procedure, for the price and sum as hereafter set forth, subject to the terms and conditions as set forth in the said petition, with the succession to pay all costs of these proceedings; purchasers to pay all closing costs of and associated with the sale.
The property to be sold at private sale is described as follows:
That certain tract or parcel of ground containing 4.93 acres, more or less, together with all buildings and improvements thereon, and all rights, ways, privileges, servitudes and appurtenances thereunto appertaining, situated in Section 22, Township 7 South, Range 3 East, St. Landry Parish, Louisiana, measuring 1064.70 feet on its eastern and western boundaries, and 201.54 on its northern and southern boundaries, and being more particularly identified as the northernmost 1064.70 feet of “LOT 2-A” of plat of survey prepared by Aldon A. LeBlanc on July 23, 1998, a copy of which plat of survey is attached to an Act of Partition between John Curlis Courtney Savoy, et al recorded under Original Act No. 0831852, COB Z-36 at Page 584 of the records of St. Landry Parish, Louisiana, and is bounded, now or formerly on the north by property of John Burton Prather, south by the remainder of Lot 2-A, east by property of Mark Clyde Lavergne, et ux, and on the west by Anthony R. Andrus, et ux.
Being part of the same property acquired by John Curlis Courtney Savoy, et al from Gertrude Bourque, wife of/and John Clinton Savoie (Savoy) in Donation Inter Vivos dated June 13, 1980, recorded June 30, 1980, under Act No. 644552, Donation Book 27 at Page 739 of the records of St. Landry Parish, LA; see also Act of Partition between John Curlis Courtney Savoy, et al recorded July 29, 1998, under Act No. 0831852, Book Z-36 at Page 584 of the records of St. Landry Parish, LA.
for the price and sum of $17,500.00, payable in cash, subject to the terms, conditions and limitations of warranty, etc. as deemed necessary and appropriate by the testamentary executrix of these succession proceedings.
NOTICE IS HEREBY GIVEN to all creditors and heirs to show cause within seven (7) days, including Sundays and holidays, from the day whereon the last publication of this notice appears why the said authorization should not be granted.
