THE MAYOR AND BOARD OF ALDERMEN AND ALDERWOMEN, THE GOVERNING AUTHORITY OF THE CITY OF EUNICE, PARISHES OF ST. LANDRY/ACADIA, STATE OF LOUISIANA, met in regular session on Tuesday, May 14, 2024 at six-thirty (6:30) o’ clock p.m. at their regular meeting place, the Eunice City Hall.
The Mayor announced a quorum was present and ready to transact business.
WHEREUPON, the following Ordinance was introduced for consideration of adoption on motion by Alderman Randall Reed, seconded by Alderman at Large Marion “Nootsie” Sattler and carried.
ORDINANCE NO. 0524(C)
An Ordinance enlarging and extending the boundaries of the municipality of Eunice, Louisiana, so as to include within the corporate limits of said municipality, a certain tract of or parcel of land containing 1.38 acres situated in Section 35, T-6-S, R-1-W, St. Landry Parish Louisiana being a portion of the north 3.00 acres of 6.07 acre parcel as shown on plat of survey prepared for Sattler Supply Company by John H. Miller, PLS and dated October 3, 2022.
WHEREAS, in accordance with Louisiana Law, a petition has been filed by G.V.C.S., Inc. DBA Whataburger, who is represented herein by Chris Johnson, and with its registered business address at 421 North Timberland, Lufkin, Texas 705901, hereinafter sometimes referred to as “Petitioner,” seeking to have property which it owns to be annexed into the City of Eunice submitted at the regular meeting of the Council on May 14, 2024, it having been certified by the St. Landry Parish Registrar of Voters and the St. Landry Parish Assessor that the requirements of Louisiana Law have been complied with, and
WHEREAS, it is deemed advisable, expedient, and desirable to annex said property and being that this body has the delegated authority to adopt this Ordinance.
BE IT ORDAINED by the Mayor and Board of Aldermen of the City of Eunice, Louisiana, the governing authority of the Municipality of Eunice, in this session convened, as follows:
Section I:
That the boundaries and corporate limits of the City of Eunice, Louisiana, be expanded and enlarged to include within its corporate limits the property described to-wit:
Beginning at a found 5/8” Iron rod on the apparent south right-of-way line of US Hwy. 190 lying west approximately 629.5 feet from west right-of-way line of La Hwy. 757 and being the northwest corner of said 3.00 acre tract and northwest corner of herein described 1.38 acre tract;
Thence from said point of beginning south 88”43’05” east 200.05 feet along apparent US Hwy. 190 south right-of-way line to set 5/8” iron rod at northeast corner;
Thence south 00”02’28” east 300.08 feet to a set 5/8” iron rod at southeast corner;
Thence north 88”43’05” west 200.05 feet to a set 5/8” iron rod at southwest corner;
Thence north 0”02’26” west 300.08 feet to said point of beginning.
Said property having an area of 1.38 acres and being shown on plat of survey prepared for Robert Sattler by Aucoin & Associates, Inc. date 10-31-23.
Attached hereto and made a part hereof, marked for identification as “Exhibit 1” is a map of the above described property.
Section 2:
That all of the property and territory described in Section I hereinabove is hereby declared to be within the Corporate Limits of the City of Eunice, Louisiana, with a zoning classification of B-2, Highway Business.
Section 3:
That this Ordinance be published once in THE EUNICE NEWS, a newspaper having a general circulation in the City of Eunice, and that thirty (30) days after the date of said publication, this Ordinance shall become operative in accordance with Louisiana Law.
Section 4:
That all Ordinances, or parts of Ordinances, inconsistent or in conflict herewith are hereby repealed.
Section 5:
That should any provision of the Ordinance be found to violate the Constitution or be declared illegal for any reason, it shall not affect the other provisions of this Ordinance.
