A customer at Tobacco Plus opened a restroom door to find a unconscious and naked man on the toilet with a crying child on the floor, Eunice Police Lt. Ryan Young said.
The man’s pants were down to his ankles and there was a syringe on the ground, Young said.
A soft drink can was upside down on the lavatory with an unknown substance on top of it, he said.
The customer tried to wake the man up but he failed to respond.
The child, who was behind the toilet, was removed from the bathroom by the customer.
The customer notified employees and police were called at about 3 p.m. Tuesday.
Young said the man was in the same unconscious state when officers arrived.
An ambulance crew checked the man out before he was brought to the city jail, he said.
The man is identified as Byrson Gaige Bertrand, 28, 200 block of Eula Street, Eunice. He is charged with child desertion, illegal use of controlled dangerous substances in the presence of a juvenile and possession of drug paraphernalia.
The child was interviewed and released to the custody of his biological mother.
